Terms of Service

1. Acceptance of Terms

By accessing or using TeleScribe (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Black Health Intelligence Pty Ltd (ABN: 23 693 026 112) (“BHI”, “we”, “us”, “our”). The business name “telescribe” is registered with ASIC under the Business Names Registration Act 2011.

2. Description of Service

TeleScribe is an AI-assisted clinical documentation tool that provides audio transcription and structured clinical note generation for clinical consultations (in-person, telehealth, and hybrid). The Service is a documentation aid — it assists clinicians with drafting clinical notes. It is not a diagnostic tool, prognostic tool, or clinical decision support system.

3. Draft Documentation Disclaimer

All outputs generated by TeleScribe are draft documentation only.

  • AI-generated notes are not clinical decision support
  • AI-generated notes are not diagnosis or treatment recommendations
  • AI-generated content may contain errors, omissions, hallucinations, or inaccuracies
  • Ambiguous or unclear content is marked with [unclear] markers but may not capture all uncertainty
  • Transcription may contain errors, particularly with medical terminology, accents, or poor audio quality

No clinical action should be taken based solely on AI-generated content without clinician review.

4. Clinician Responsibility

In accordance with RACGP and Avant guidance on AI-assisted clinical documentation:

  • The clinician is the final authority on all clinical documentation
  • You must review all AI-generated drafts for accuracy and completeness before finalisation
  • You must correct errors, add key negatives, and ensure clinical reasoning is documented
  • You must ensure all documentation complies with Good Medical Practice guidelines and MBS rules
  • Professional obligations under AHPRA and relevant registration boards remain your responsibility
  • Notes are not automatically pushed to any EMR — you explicitly accept and export finalised documentation

5. Patient Consent Obligations

Per RACGP and Avant recommendations, you must obtain informed patient consent before using TeleScribe during consultations. Consent should cover:

  • That the consultation audio will be recorded
  • That AI will be used to assist with clinical documentation
  • That a clinician will review and finalise all notes
  • That audio is processed in real time and not stored
  • That data may be processed by third-party AI providers (with contractual protections)

Patients must be offered the option to opt out of AI scribe use without penalty. You are responsible for documenting consent in the patient record.

For meeting-minutes mode, you must confirm that all participants were informed and consented before recording. You must not use TeleScribe for covert or unauthorised recording. You remain responsible for compliance with applicable surveillance and listening-device laws in your jurisdiction.

6. Account Terms

  • You must be a registered health practitioner (or an authorised delegate acting under supervision) to use the clinical features of the Service
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorised access to your account
  • You may not share your account credentials with other users

7. Acceptable Use

You agree to use TeleScribe only for legitimate clinical documentation purposes. You must not:

  • Attempt to extract, reverse-engineer, or replicate training data or model weights
  • Use the Service for any purpose other than clinical documentation
  • Share account credentials with unauthorised parties
  • Attempt to circumvent security measures or access controls
  • Use the Service in any way that violates applicable laws or regulations

8. AI Limitations

You acknowledge that:

  • AI may produce inaccurate, incomplete, or inappropriate content
  • Transcription errors are possible, particularly with medical terminology, accents, background noise, or poor audio quality
  • The AI has no access to patient history, previous consultations, or any clinical context beyond the current consultation audio
  • AI-generated content must never be used without clinician review
  • The quality of outputs depends on the quality of the audio input

9. TGA Compliance

TeleScribe is a documentation aid and is not intended to be a software-based medical device under the Therapeutic Goods Administration (TGA) classification framework. This classification is consistent with the TGA's Digital Scribes guidance (5 February 2026) and the Therapeutic Goods Act 1989. The Service's functionality is limited to:

  • Audio transcription (converting speech to text)
  • Clinical note summarisation and structuring (organising transcript content into clinical note formats)

The Service does not provide clinical decision support, diagnostic suggestions, treatment recommendations, or any output intended to influence clinical decisions. The TGA's Compliance Principles for 2026 and 2027 identify software as a medical device (SaMD) as a priority focus area — TeleScribe maintains strict separation between documentation assistance and clinical decision support to ensure ongoing compliance.

10. TeleCheck Advisory Services

TeleScribe includes TeleCheck, an integrated advisory tool that provides Medicare disaster eligibility checking and MBS item suggestions. You acknowledge and agree that:

  • All TeleCheck outputs are advisory only and do not constitute billing advice, legal advice, or a guarantee of Medicare eligibility
  • Eligibility data is sourced from publicly available disaster declarations and the MBS Schedule, synced daily from official sources
  • Clinicians are solely responsible for independently verifying billing eligibility, selecting the correct MBS item, and ensuring compliance with Medicare rules
  • BHI is not liable for billing errors, rejected claims, or financial losses arising from reliance on TeleCheck outputs without independent verification
  • Alternative telehealth pathway information (sexual/reproductive health, mental health, chronic disease management) is provided for general awareness only and does not replace clinical or billing judgement

11. Privacy and Data Handling

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

Key points: audio is never stored; core data is stored in Australia; patient data is never used for AI model training.

12. Intellectual Property

  • Your content — clinical notes and transcripts generated through TeleScribe belong to you (the clinician or your practice). We do not claim ownership of your clinical documentation.
  • Our platform — the TeleScribe platform, software, design, and technology remain the intellectual property of Black Health Intelligence Pty Ltd.

13. Subscription and Billing

  • TeleScribe offers a free trial period for new users
  • Paid subscriptions are billed in advance on a recurring basis
  • Payment is processed securely by Stripe
  • You may cancel your subscription at any time; access continues until the end of the current billing period
  • We reserve the right to modify pricing with 30 days' notice to existing subscribers

Fair Use Policy

TeleScribe plans include unlimited clinical note generation for normal clinical practice. BHI will monitor usage patterns, including consultation volumes, concurrent sessions, and processing minutes, to ensure fair and reasonable use relative to normal clinical practice patterns.

If your usage consistently exceeds reasonable levels (taking into account normal clinical practice patterns for your specialty and plan type), BHI may:

  • Discuss your usage with you to understand your needs
  • Recommend an alternative plan or additional seats that better reflects your actual usage
  • Adjust your subscription and associated fees to reflect actual usage
  • Implement usage guidance or processing limits if agreement cannot be reached

BHI will provide at least 14 days' written notice before implementing any usage adjustments or mandatory subscription changes. The fair use policy is intended to ensure sustainable service quality for all users, not to restrict normal clinical workflows.

14. Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied.

  • BHI is not liable for clinical decisions made based on AI-generated content
  • BHI is not liable for transcription errors, omissions, or inaccuracies in generated notes
  • BHI is not liable for any loss or damage arising from reliance on AI-generated documentation without clinician review
  • To the maximum extent permitted by law, BHI's total liability is limited to the fees you have paid in the 12 months preceding the claim

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

15. Indemnification

You agree to indemnify and hold harmless BHI and its directors, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

  • Your use of AI-generated content in clinical practice
  • Clinical decisions made based on or informed by TeleScribe outputs
  • Failure to obtain appropriate patient consent
  • Violation of these Terms or applicable laws

16. Governing Law

These Terms are governed by the laws of the Commonwealth of Australia. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts of Australia.
